SHALOM – Jewish Community
This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “You”) and the provider of the SHALOM app (“App Provider” or “We”) governing your use of the SHALOM mobile application (“App”).
By downloading, installing, or using the SHALOM app, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the App.
1. License Grant
App Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the SHALOM app for personal, non-commercial purposes, subject to the terms and conditions set forth in this EULA.
2. User-Generated Content
The App may allow users to submit, upload, publish, or share content, including but not limited to reviews, photos, comments, and other materials (“User-Generated Content”).
2.1 Acceptable Use
You agree not to post any User-Generated Content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Is antisemitic or promotes hatred against any group or individual, particularly based on religion, race, ethnicity, or nationality.
- Uses the App to identify, locate, or target Jewish locations or individuals for the purpose of harm, harassment, or abuse.
- Violates any laws or regulations.
- Infringes on the intellectual property or other rights of any third party.
- Contains any form of spam, advertising, or solicitation.
2.2 Content Moderation
We reserve the right, but are not obligated, to monitor, edit, or remove User-Generated Content that we determine, in our sole discretion, violates this EULA or is otherwise objectionable.
3. User Registration
You may be required to create an account to use certain features of the App. When creating an account, you agree to:
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your account and password.
- Notify us immediately of any unauthorized use of your account.
4. Posting and Adding Locations
Registered users can post content and add new locations. When you add a new location or post content, you agree to:
- Provide accurate and truthful information.
- Obtain all necessary rights and permissions to add the location or post the content.
- Not add or post any content that violates this EULA or any applicable laws.
5. Ratings and Reviews
You may rate and review locations. When you do so, you agree to:
- Provide honest, fair, and constructive feedback.
- Not post false or misleading ratings or reviews.
- Not manipulate or interfere with the ratings and review system.
6. User Conduct
You agree to use the App in compliance with all applicable laws and not to:
- Use the App for any unlawful purpose.
- Use the App to target Jewish locations or individuals for harm, harassment, or abusive purposes.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the operation of the App or servers or networks connected to the App.
7. Reporting and Enforcement
Users can report abusive or objectionable content through the App’s reporting feature. We will review all reports and take appropriate action, which may include removing content and/or suspending or terminating the accounts of violators.
8. Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for conduct that we believe violates this EULA or is harmful to other users of the App, us, or third parties, or for any other reason in our sole discretion.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. App Provider does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components.
10. Limitation of Liability
In no event shall App Provider, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if App Provider has been advised of the possibility of such damages.
11. Changes to this EULA
We may modify this EULA at any time. If we do, we will provide notice of the changes within the App or by other means. Your continued use of the App following the posting of changes will mean that you accept and agree to the changes.
12. Governing Law
This EULA and your use of the App will be governed by and construed in accordance with the laws of the State of Israel, without giving effect to any principles of conflicts of law.
For international users, by using the App, you agree that the laws of the State of Israel will apply to any disputes arising out of or relating to this EULA or the App. However, you may also have rights under your local laws.
